AIG is suing Bill Cosby now over the policy that should cover him against personal injury claims. OUCH!

Bill Cosby, citing financial pressures, asked a federal judge to dismiss or put on hold a lawsuit in which American International Group Inc seeks to avoid paying for his defense against defamation claims by women who also accused him of sexual abuse.

AIG had in June sued Cosby in Massachusetts and California over homeowner’s insurance policies it issued to him in those states. It said these provide coverage for personal injury claims, which include defamation, but not for personal injury claims arising from “sexual, physical or mental abuse.”

Cosby is defending against defamation lawsuits by Tamara Green, Therese Serignese, Linda Traitz in Massachusetts, and the model Janice Dickinson in California, spurred by denials by the entertainer or his representatives of claims of sexual misconduct.

Pa just noted that the statute of limitations hasn't run out on his last victim. This could get to a criminal case now. But it's complex. Well worth a read into the issues.

It has to be for rape to persist for 10 years though. Might be tough to make that case.

If the latest two accusations are from 2004 and 2008, there are probably other victims from that time frame. I imagine other potential accusers are watching to see what happens with these cases.

The statute of limitations for minor victims is tolled until their majority.
The way a lot of catastrophes happen is that X doesn't occur because there are safeguards in place, therefore people assume X isn't a worry and they remove the safeguards. Then X happens.

Disagree to a degree here. I'm very uncomfortable with a DA in his last election saying that he'll indict Crosby as a campaign promise. Process matters.

I agree that a promise like that is inappropriate, the articles I've read about the unsealed testimony certainly appears to make the case that pressing charges was the appropriate action.

IIRC, nobody many any sort of promise to that effect. The outgoing DA just didn't feel it was appropriate to saddle the incoming one with this rather sticky case. Both were solid no-nonsense figures.

Rabs, I was on a tangent. My post referred to Ferman (the last DA after Castor, who had the case back in 2005) not pulling the trigger since she wasn't running. Steele certainly did go after Castor (who did make a promise not to prosecute), and won (perhaps on that basis- but unlikely).

But the judge just overruled Castor's promise, since he had neither the authority to do so, nor put it in writing in the first place. This pretty well sums it all up. Cosby is gonna be toast. The case is proceeding, and the dep will likely be entered. Ari, would love your thoughts on this.

It appears that Bill Cosby may have to answer for his actions in at least one incident. It also appears that his lawyer either kept poor records or was far too trusting of a "word" with a handshake.

Given what has been released of Cosby's own testimony in civil cases? If it walks like a duck and talks like one, too?...

That testimony was given expressly due to the promise Castor made. So whether it can be used is still open for debate.
